During the 113th Congress, policy makers have conducted oversight of the Commodity Futures Trading Commission, including the Commission’s regulation of Commodity Trading Advisors and Commodity Pool Operators and CFTC Reauthorization.

The Dodd-Frank Act expanded the definition of Commodity Trading Advisor and Commodity Pool Operator in the Commodity Exchange Act to include entities operating pooled investment vehicles and managing commodity trading accounts that enter into swaps.

The Act also amended the definition of “commodity pool” to include pooled investment vehicles that trade commodities – including pools that enter into non-security-based swaps.

As a result of the Dodd-Frank Act and a recent amendment to the registration requirements, many investment managers or fund sponsors will now be required to register as Commodity Trading Advisors and/or Commodity Pool Operators.
